Non-Paying Bidder Policy

Welcome to the Non-Paying Bidder Policy for Bid4Me.org ("Non-Paying Bidder Policy"). The services available at http://www.Bid4Me.org and http://www.Bid4Me.co.uk are provided by the QMP team ("Bid4Me", "we", "us" or "our").

Unpaid bids and purchases can usually be resolved by direct communication between Bid4Me and buyers. In such cases, Bid4Me provides an online process through which the seller can communicate with us to resolve the situation. Please note that Bid4Me's Non-Paying Bidder Policy, Terms and Conditions and User Agreement make clear that buyers must pay for the listings that they commit to purchase.

Typically there are three steps to the Unpaid Item process:

  1. Seller files an official Non-Paying Bidder dispute.

Sellers can report an Unpaid Item up to 30 days after the transaction date (i.e. the date on which the auction closed). Usually the seller must wait 7 days after a listing closes to file an Unpaid Item dispute.

    File an Unpaid Item dispute

  2. Bid4Me contacts the buyer.

Once the seller files an official Non-Paying Bidder dispute, Bid4Me sends the buyer an email notification which will provide details on one of the following situations:

Friendly reminder to pay - the email message will remind the buyer that payment has not been received, along with simple instructions on how to pay for the listing. If the buyer does not respond to the email message within 7 days, the bidder will have their account suspended and may be charged a Fee to have their account re-activated. The dispute will be closed immediately after the buyer responds and the seller will not be eligible to re-file a Non-Paying Bidder dispute for that transaction. If the buyer does not respond to the email message within 7 days then the seller may be asked to close the dispute or choose to pursue the matter using a third party mediator for example.

We may change this policy at any time, and any change will be effective after the expiry of 14 days following the date of posting on the announcements board on the Site (or such later date as we may notify).

  3. Closing the dispute.

The seller can close the dispute after the buyer has responded at least once, or if the buyer does not respond within 7 days. A seller can find all Unpaid listings they have in their 'Control Panel'. The seller has several options to close the dispute:

The transaction is complete and we're both satisfied. With this option, the seller need do nothing and the buyer does not receive an Unpaid Auction strike.

I no longer wish to communicate with or wait for the buyer. With this option, the buyer receives an Unpaid Auction strike, the seller again need do nothing and the auction is eligible for a relist.

A dispute can only be open for 14 days after the official Non-Paying Bidder dispute being sent. If the seller has not closed the dispute within the 14 days, it will be automatically closed. When this automatic closure takes place the buyers account will be automatically suspended.

    Note:
    Feedback and Unpaid Items

Buyers and sellers may leave feedback for each other on transactions involving Unpaid listings even if there was an agreement not to complete the transaction. Bid4Me encourages all users to leave appropriate feedback about our members. Unpaid Auction strikes do not affect a user's feedback score or member profile.

If any provision of the Non-Paying Bidder Policy are held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforceable. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

This Agreement will prevail over any conditions of sale imposed by a seller and our Privacy Policy, User Agreement, Forum Usage Policy and Terms and Conditions are incorporated in this User Agreement by reference. Each of the policies may be amended from time to time and material changes will be posted in the House Party Forum except for the Privacy Policy for which we will provide you with thirty days notice.
